Salt Lake City International Airport Mobile App

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF USE CAREFULLY BEFORE INSTALLING OR USING THIS MOBILE APPLICATION

AGREEMENT TO BE BOUND:

By downloading, browsing, accessing or using this mobile application (“Mobile App”) you agree to be bound by these Terms and Conditions of Use. The Salt Lake City International Airport (“Airport”) reserves the right to amend these terms and conditions at any time. If you disagree with any of these Terms and Conditions of Use, you must immediately discontinue your access to the Mobile App and your use of the services offered on the Mobile App. Continued use of the Mobile App will constitute acceptance of these Terms and Conditions of Use, as may be amended from time to time. 

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY:

THIS MOBILE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. THE AIRPORT DOES NOT WARRANT THAT THE MOBILE APP WILL OPERATE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL OR DAMAGING CODE. WHILE THE AIRPORT MAY USE REASONABLE EFFORTS TO ENSURE THE MOBILE APP CONTAINS ACCURATE AND CURRENT INFORMATION. THE AIRPORT MAKES NO WARRANTIES OR REPRESENTATIONS AS TO THE ACCURACY OR COMPLETENESS OF THE INFORMATION CONTAINED THEREIN.

THE AIRPORT MAKES NO EXPRESS WARRANTIES. USER WAIVES ALL IMPLIED WARRANTIES INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE, NON INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE REGARDING ANY MERCHANDISE, INFORMATION OR SERVICE PROVIDED THROUGH THE MOBILE APP. USER EXPRESSLY ACKNOWLEDGES THAT THERE ARE RISKS, AND ASSUMES ALL RESPONSIBILITY RELATED TO, THE SECURITY, PRIVACY AND CONFIDENTIALITY RISKS INHERENT IN WIRELESS COMMUNICATIONS AND TECHNOLOGY.  THE AIRPORT DOES NOT MAKE ANY ASSURANCES OR WARRANTIES RELATING TO SUCH RISKS. NO ADVICE OR INFORMATION GIVEN BY THE AIRPORT OR ITS REPRESENTATIVES SHALL CREATE A WARRANTY. 

THE AIRPORT AND ITS EMPLOYEES ARE NOT LIABLE, IN CONTRACT OR IN TORT, FOR ANY COSTS OR DAMAGES ARISING, EITHER DIRECTLY OR INDIRECTLY, FROM USER’S USE OF THE MOBILE APP, SPECIFICALLY INCLUDING ANY INDIRECT, INCIDENTAL, EXEMPLARY, MULTIPLE, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES.

THE AIRPORT AND ITS EMPLOYEES ARE NOT LIABLE FOR ANY ACTS OR OMISSIONS OF ANY THIRD PARTIES, HOWEVER CAUSED, RESULTING FROM OR IN CONNECTION WITH USE OF THE MOBILE APP, INCLUDING RELIANCE ON THE INFORMATION IN THE MOBILE APP OR ANY INACCURACIES IN THE INFORMATION OR ITS TRANSMISSION, INCLUDING ANY DIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES OR OTHER INTANGIBLE LOSS.

INTELLECTUAL PROPERTY RIGHTS:

All editorial content, information, photographs, illustrations, artwork and other graphic materials, and names, logos and trade marks on the Mobile App are protected by copyright laws and/or other laws and/or international treaties, and belong to the Airport and/or our suppliers, as the case may be. These works, logos, graphics, sounds or images may not be copied, reproduced, retransmitted, distributed, disseminated, sold, published, broadcasted or circulated whether in whole or in part, unless expressly permitted by the Airport and/or our suppliers, as the case may be. Nothing contained on the Mobile App should be construed as granting by implication, estoppel, or otherwise, any license or right to use any trademark displayed on the Mobile App without written permission of the Airport. Misuse of any trademarks or any other content displayed on the Mobile App is prohibited.

In the event that User violates this acceptable use policy, the Airport may take any one or more of the following actions, or other actions not listed, at the Airport’s sole discretion: (1) issue warnings: written or verbal; (2) temporarily suspend User’s access to the System; (3) permanently terminate User’s access to the System; and/or (4) bring legal action to enjoin violations and/or to collect damages, if any, caused by violations.

NOTICE OF PROBLEMS OR COMPLAINTS:

User may report a problem or error concerning use of the Mobile App by sending an e-mail with details of the problem to airportinfo@slcgov.com.

TERMINATION:

Without prior notice, the Airport may terminate this Agreement or User’s access to the Mobile App for any reason.

INDEMNIFICATION:

User agrees to defend, indemnify, and hold the Airport harmless from and against any and all claims, demands, actions, liabilities, costs or damages arising out of User’s use of the Service or of any violation by User of this Agreement. User further agrees to pay Airport’s reasonable attorneys’ fees, experts’ fees and other costs in any action or claim under this Agreement.

MODIFICATION OF AGREEMENT:

Airport may, at its sole discretion, modify the terms and conditions of this Agreement.  Such modifications shall be binding and effective upon the date of posting.  User agrees to review the terms and conditions prior to each use of the Mobile App to maintain awareness of any modifications. By continuing to use the Mobile App after such postings, User agrees to accept and agree to any and all such modifications.

JURISDICTION, VENUE AND LIMITATIONS:

This Agreement is governed by Utah law without regard to conflict of law provisions. The federal and state courts located in Utah alone have jurisdiction over all disputes arising out of or related to this Agreement and the Mobile App. User consents to the personal jurisdiction of such courts sitting in Utah with respect to such matters.  User further agrees, unless prohibited by law, that any controversy, claim, or dispute related to this Agreement or the Mobile App must be brought by User within one (1) year of the date User is entitled to assert such claim.

SEVERABILITY

If any provision of these terms and conditions is held to be unenforceable, such holding will not affect the validity of any of the other provisions of these terms and conditions.
